The following terminology applies to these Terms and Conditions, privacy statement and any disclaimer notice and any or all Agreements: “Client”, “You” and “Your” refers to you, the person accessing this website and seeking medical assistance from third party Hospitals and doctors. “The Company”, “Ourselves”, “We” and “Us”, refers to our Company. “Party”, “Parties”, or “Us”, refers to both the Client and ourselves, or either the Client or ourselves. “User” refers to both clients and hospitals. All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner, whether by formal meetings of a fixed duration, or any other means, for the express purpose of meeting the Client’s needs in respect of provision of the Company’s stated services, in accordance with and subject to, prevailing New South Wales and Australian Law. Any use of the above terminology or other words in the singular, plural, capitalisation and/or he/she or they, are taken as interchangeable and therefore as referring to same.

Service agreement terms and conditions

We do not operate or control any hospital that is mentioned in the treatment package. We take complete care in selecting the most reputed treatment facilities for different types of ailment but we do not have any control in running these institutions and so we cannot be made liable for any delay, improper services, failure or deficiency in services provided by the institutions for any accident, injury, discomfort, sickness, death or any kind of damage that may arise due to any act of negligence of service by the employees or management of the institution.

We do not provide any medical advice what so ever. Our role is to introduce the patient to the hospital and its Dr’s. The patient is expected to make his own enquiries about the Dr and the hospital facilities. We may guide and help the patient make the booking with the hospital and may also suggest where the best accommodation and transfer facilities can be booked.

Terms And Conditions Of Medical Treatment

The patient/participant or his/her family members/friends making the booking on behalf of the patient/participant need to read all the terms and conditions mentioned in the registration forms before signing. The terms and conditions that are set in the registration forms are also provided in the package quote. A copy of this is provided to the patient/participant or his/her family members/friends making the booking on behalf of the patient/participant. When the forms are signed by the patient/participant or his/her family members/friends making the booking on behalf of the patient/participant it means total acceptance of the terms and conditions that have been specified in the forms. The signed documents shall be binding on the patient/participant or his/her family members/friends making the booking on behalf of the patient/participant. This will constitute a contract between us and the patient/participant or his/her family members/friends making the booking on behalf of the patient/participant.

We do not control or operate any of the hospitals providing the treatment facilities that are mentioned in the package. As we take utmost care in selection of hospitals we cannot be held liable for any delay, improper services, failure or deficiency in services provided by the institutions for any accident, injury, discomfort, sickness, death or any kind of damage that may arise due to any act of negligence of service by the employees or management of the institution.

Unless otherwise stated, Medical Tourism Abroad owns the intellectual property rights in the website and material on the website. Subject to the license below, all these intellectual property rights are reserved. You may view, download for caching purposes only, and print pages from the website for your own personal use, subject to the restrictions set out below and elsewhere in these terms and conditions. You must not use this website to copy, store, host, transmit, send, use, publish or distribute any material which consists of (or is linked to) any spyware, computer virus, Trojan horse, worm, keystroke logger, rootkit or other malicious computer software. Medical Tourism Abroad merely makes the Site Services available to enable Clients to identify and determine the suitability of Hospitals and doctors for themselves. Medical Tourism Abroad does not direct, has no control over, makes no representations, and does not guarantee the quality, safety, or legality of Hospitals and Doctors Services; the truth or accuracy of advertisements; the qualifications, background, or identities of doctors; the ability of Hospitals and Doctors to deliver Services; the ability of Clients to pay for Hospitals and Doctors Services. Medical Tourism Abroad is not required to and may not verify any information given to us by Freelancers or Clients, nor does Medical Tourism Abroad perform background checks on Freelancers or Clients. YOU HEREBY ACKNOWLEDGE AND AGREE THAT MEDICAL TOURISM ABROAD MAY PROVIDE INFORMATION ABOUT A HOSPITAL AND DOCTOR OR CLIENT. HOWEVER, SUCH INFORMATION IS BASED SOLELY ON DATA THAT HOSPITALS AND DOCTORS OR CLIENT SUBMITS TO MEDICAL TOURISM ABROAD, AND MEDICAL TOURISM ABROAD PROVIDES SUCH INFORMATION SOLELY FOR THE CONVENIENCE OF MEMBERS AND IS NOT AN INTRODUCTION, ENDORSEMENT, OR RECOMMENDATION BY MEDICAL TOURISM ABROAD.

Hospitals/Institutions For Treatment

The hospital/institution shall be solely responsible for all treatment procedures provided to the patient/participant. Any complication or emergency arising out of the treatment process is the sole responsibility of the hospital/institution and we will not be liable for the same. If the patient/participant having any kind of complaint owing to delay, improper services, failure or deficiency in services provided by the institutions for any accident, injury, discomfort, sickness, death or any kind of damage that may arise due to any act of negligence of service by the employees or management of the institution they need to complain directly to the institution and not to us.

Limitations of liability

Medical Tourism Abroad will not be liable to you whether under the law of contact, the law of torts or otherwise in relation to the contents of, or use of, or otherwise in connection with, this website: (i) for any direct loss; (ii) for any indirect, special or consequential loss; or (iii) for any business losses, loss of revenue, income, profits or anticipated savings, loss of contracts or business relationships, loss of reputation or goodwill, or loss or corruption of information or data. These limitations of liability apply even if Medical Tourism Abroad has been expressly advised of the potential loss.

Exceptions

Nothing in this website disclaimer will exclude or limit any warranty implied by law that it would be unlawful to exclude or limit; and nothing in this website disclaimer will exclude or limit Medical Tourism Abroad’s liability in respect of any: (i) death or personal injury caused by Medical Tourism Abroad’s negligence; (ii) fraud or fraudulent misrepresentation on the part of Medical Tourism Abroad; or (iii) matter which it would be illegal or unlawful for Medical Tourism Abroad to exclude or limit, or to attempt or purport to exclude or limit, its liability.

Reasonableness
